WESTFALL, Jacob (CORNELIUS4,
ABLE3, JOHN2, JURIAEN1) Sgt. Jacob Westfall served under Capt. Abel Westfall in the 8th Virginia Regiment during the American Revolution. It appears from the muster rolls that he was ill much of the time during his enlistment.
In September, 1776 a Jacob Westfall Jr. and a Jacob Westfall Sr. were among the signers in Tygarts Valley of a petition to the Governor of Virginia for a troop of Rangers to protect them from the Indians (the junior and senior meant that one was older than the other, not that they were father and son). In 1795 a complaint was recorded in Randolph County saying two orphans,sons of Jacob Westfall, living with Hezekiah Rosecrance ought to be bound. Later that same year Joseph and Jonathan Westfall were bound to Hezekiah Rosencranz until the age of 21. The following year Joseph Westfall came before the court claiming to be almost 21 (so that he was no longer bound as a minor orphan). In 1802 the will for Joseph Westfall was recorded in Randolph County naming his brother Cornelius of Harrison County and another brother named Jonathan. At that time the only Cornelius Westfall found in the records of Harrison County was the Cornelius who married Elizabeth Helmick (all others were in Randolph, Hampshire or Pendleton). Our Cornelius was the son of Jacob and grandson of Cornelius (Bogart) Westfall and Elizabeth Westfall. Jacob died in Hardy or Randolph County, Virginia sometime before 1795 when sons Joseph and Jonathan were bound to Hezekiah Rosencranz. Jacob Westfall was the brother of Zachariah Westfall and brother-in-law of Hezekiah Rosencrans. |

Spouse | Some researchers have thought that one of the Jacob Westfall's in the records of Randolph County, Virginia was married to Sidney Pugh. This is very unlikely. Sidney Westfall married Christopher Lamberton in Randolph County on 16 March 1802. The name of Jacob's wife is uncertain at this time. | ||

Speaker, President, and Gentlemen of the Convention of Virginia. The Petition
of the inhabitants of Tigers Valley most humbly sheweth; Theat your Petitioners
being in a very remote situation and the very extent of the frontiers
and not within less than eighty miles of any relief in case of an emergency,
which now we daily expect from the indians, and as our inhabitants consist
of about one hundred and fifty families in the course of fifty miles upon
the said river of Tigers Valley and including Buchannan NOTWITHSTANDING
our weakness and inability we unamiously are willing to exert our utmost
endeavours to withstand the enemy. Therefore we you petitioners beg leave

Hampshire Co., Va., March 11, 1783 - "In the name of God Amen, I Cornelius Westfall of the County of Hampshire and the state of Virginia being very sick and weak but of perfect mind and memory ... do make and ordain this my last Will and Testament... The Worldly Estate which it has pleased God to bless me with in this life, I give ... and dispose of in the following manner...First, I give and bequeath unto my beloved wife, Magdalene Westfall, the privilege of one third of the benefit of my plantation I now dwell on as long as she shall bear the name she is now of. [Second] Also, I give and bequeath unto my son, Jacob Westfall, my smooth gun. Thirdly I give and bequeath unto my beloved sons, Isaac Westfall and Zachariah Westfall all my lands and [unreadable] an equal share with the rest of my children of the movable estate except such particulars as I shall hereafter mention. I do not mean for Isaac and Zachariah to hold the land without having it appraised and paying to such as shall be hereafter named in particularly such share of land. Fourth, I give and bequeath unto Jacob Westfall one fifth part of the value of the lands, and to Cornelius Westfall one fifth part of the value of the lands, and unto John Westfall one fifth part of the value of the lands, and my will is if my two sons, Cornelius and John, should not return that their part of the Estate shall fall to Isaac and Zachariah. [Fifth] I give and bequeath unto my daughter, Mary Westfall, a feather bed and furniture, a cow and a calf, her choice of my cattle, two ewes, her choice, and an equal share of the movable estate. Now my desire is to have the rest of the moveable estate appraised and let all my children have an equal part. INDENTURE,
ZACHARIAH WESTFALL TO JACOB WESTFALL JR.: This indenture of agreement
made this twenty-eighth day of October in the year of our Lord one thousand,
seven hundred and eighty nine, Witnesseth that I, Zachariah Westfall
of the County of Randolph and the State of Virginia for and in the consideration
of the sum of forty pounds current money of Virginia to me in hand paid
by Jacob Westfall, Jr. of the County of Hardy and the State
aforesaid, the receipt whereof I do hereby acknowledge and do by these presents
bargain and sell all my Right, Title and Claim by virtue of my Father's
last will and testament one half of a tract of land containing ninety
five acres lying in Lord Fairfax Manor on the South Branch and coursed by
John Westfall's land on the one side and Joseph Petties land
on the other side which land is now possessed by Jacob Westfall Jr. and
is in law between the said Jacob Westfall Jr. and John Singleton unto
the above named Jacob Westfall Jr. which half of ninety five acres the said
Jacob Westfall Jr. should recover the said land by law. The said land is
to be his and his heirs and assigns forever and I do hereby by these presents
in open and plain market sell and make over for myself, and my heirs all
my right and claim of the said land unto the said Jacob Westfall Jr. his
heirs and assigns by virtue of my father's last will and Testament. Now
if the said Jacob Westfall Jr. should recover the said land by law then
I, myself, my heirs or Executors are to make over a deed and lawful right
such as the law requires for the more efficient conveyance of land to the

See the above indenture by Zachariah Westfall. There were a series of law suits between Jacob Westfall and John Singleton. This was an appeal filed by Jacob Westfall to an earlier ruling that awarded the land to Singleton based on Abel Westfall's "death bed donation" to his son John. John later sold this land to Singleton although his brother Cornelius later took possession of the land. This was the final ruling that awards the land back to Jacob Westfall as the plaintiff. 1793 - Fall Term Virginia Court of Appeals;

( Pg 238) Whereas a complaint hath been make by one of the overseers of the poor of the Valley District that two orphan children, both boys, sons of Jacob Westfall deceased now living with Hezikiah Rosacrons ought to be bound. Ordered that the overseers of the Valley District do provide suitable masters for the said two boys to be bound to according to law, against the next court to be held for the county. ( Pg 244) Ordered that Joseph Westfall and Jonathon Westfall orphan children of Jacob Westfall Deceased be bound by the overseers of the poor unto Hezikiah Rosacrons until they arrive to full age according to law. Where as Joseph Westfall of this County appears to be insane and likely to become chargeable to the Commonwealth, and Zacariah Westfall came into court and said that he would give bond with security to keep the said Joseph Westfall from becoming chargeable to this county and use him the said Joseph Westfall in a good humane and friendly manner and take good care of him. Where upon the said Zacariah Westfall with Nicholas Gibson and Abraham Cutright his securities and acknowledge themselves bound unto James Munroe Esq. Governor of the Commonwealth to wit the said Zacariah Westfall in the sum of one hundred Dollars, and each of his securities above named in the sum of fifty Dollars each to be levied of their goods Lands chattels & Tenaments for the use of the said Commonwealth. Rendered on this condition that if the above bound Zacariah Westfall doth well and truly keep and take care of Joseph Westfall an insane young man and feed and cloath him in a decent manner and take good care of what property real and personal for one year from the date of these presents, which belongs to the said Joseph Westfall then the above obligations to be void otherwise remain in full force.” Zacariah Westfall, Nicholas Gibson, Abraham Cutright. know very little about Elizabeth except for her father's will, her
marriage to Cornelius and her name on the 1800 deed when the couple sold 97 acres in Tygart Valley, Randolph County. Her date of birth and death are both uncertain.
It is appears likely that she died between 1810-1815. She is apparently the woman aged 26-44 listed in the Cornelius Westfall household on the 1810 census. Cornelius remarried in 1815. |

He was still carried on O'Brian's fork for tax rolls 1931-32, but in 1840 the land was claimed by the Commonwealth (of Virginia) for non-payment of taxes. | |

MINISINK VALLEY REFORMED DUTCH CHURCH RECORDS 1716-1830, RECORDS OF BAPTISMS OF THE REFORMED CHURCH AT MACHACKEMECK (DEERPARK) 1737-1803. Baptism of Cornelius, son of Cornelius and Elizabeth Westfall 27 January 1759; children were baptized as soon as possible after birth. Sometimes as soon as a week, but depending on travel distances sometimes up to a month or more. This suggests that this Cornelius could have been born as early as December 1758. This seems to exclude him from being the Cornelius who married Elizabeth Helmick. None of the census records support this as the date of birth for our Cornelius. | ||

(Abstract of deed), Peter Cutright and Nancy his wife of Lewis County, Virginia to Cornelius & John H. Westfall "of the same place", 17 April 1830 "... in consideration of the sum of one hundred and twenty-five dollars ..." a tract of land part of 159 acres, a patent granted by the Commonwealth of Virginia to George Bogarth on 30 Oct 1779 and conveyed by deed to Peter Cutright on 22 April 1822 and recorded in Lewis County Court in Deed Book B page 284 .. [land] in Lewis County on Saul's Run a drain of Finks Run ... along each line of the patent down both sides of the glade to Cornelius Westfall's improvements thence across [the glade] with its mill and house the said piece of land containing 100 acres. 40 acres of the 100 acres at the lower end of the tract to Cornelius Westfall ... and sixty acres at the upper end of the tract to John H. Westfall. A note in the left-hand margin says, "Delivered to John H. Westfall Sept. 21st 1835." This land is along Saul's Run just south of Lorentz, Upshur County, W.Va. in a valley bounded by a ridge on each side. The pictures on the right are from when I visited the area along with my daughter in April 2008. All of this valley would have belonged to Cornelius and John H. Westfall, our ancestors. Before that this land belonged to Peter Cutright and wife Nancy (Westfall) Cutright. Nancy was the oldest daughter of Cornelius. This is an absolutely beautiful spot. Cornelius and John H. lived in the area that is today Upshur County. They apparently came there from Bryant's Fork of Salt Lick Creek, which we have not located on WV maps. Westfall being at his house and having previously heard that he had applied
for a pension and that subject being introduced in conversation, he Jackson
to Westfall.."that in swearing that he had been a soldier in the
Revolutionary War he had sworn to a lie." Westfall replied,
"you don't know as much as you think you do." Jackson
then read and explained the Pension Law to Westfall, after which Westfall
said he had been [unreadable] upon "by them fellows" that he
has been made to believe that he was entitled to a pension for service
in the Indian wars that were carried on after the War of the Revolution
had terminated. Westfall had told Jackson that Jonathan Wamsley
"had done him disservice." |

lists as many as eight children. I can only document
Elizabeth Cutright, born about 1818 and apparently never
married; Nancy J. Cutright, born about 1840; possibly
Rebecca Cutright, born about 1845 (I am inclined to believe
she may have been a grandchild). Other family trees
give the names Barbara, Prudence, Cornelius, Phoebe and
Salathiel(?) Cutright. I cannot document any of
these as children of Nancy and Peter.

She was born Abt. 1809 in Virginia, and died Bef. August 1847 in Lewis Co., (West) Virginia. He married (2) LYDIA (WILSON) SMITH April 19, 1851 in Lewis County, (West) Virginia. She was born June 1820 in (West) Virginia, the daughter of George H. and Nancy Wilson; she died October 12, 1907 in Lewis Co., West Virginia. She is buried in the Harrison Grove Cemetery on Murphy's Creek Road in Lewis County south of Weston. Lydia was married first to Solomon P. Smith about 1837. John H. Westfall jointly paid taxes with father Cornelius Westfall on 100 acres of land on Sand Run, in Lewis Co.

Marriage record, 19 April 1851, John H. Westfall and Lydia Smith. Lydia, age 50, appears in the household of her son Nathaniel Westfall on the 1880 census in the Hackers Creek Dist. of Lewis County, West Virginia. She appears on the 1900 census of Lewis Co. in the household of Henry McCall. Her age is 79 and her relationship to the head of household is listed as grandmother. Henry McCall was born April 1877, his wife Matilda was born in August 1879, Their son Frank was born in December 1898. Also in the household is Henry's brother, age 17 (born August 1883). My grandmother (Osa Westfall Corbett) remembered her grandmother Lydia Wilson Westfall because she lived off and on with the family. She also remembered her Smith uncles and her uncle Peter Westfall. Most of the Westfall family stories were given to my grandmother by her grandmother, Lydia Westfall. Lydia died when my grandmother was ten (1907) and is buried in the old Harrison Grove Cemetery, Murphy's Creek, Lewis Co., W. Va. Marriage Certificate

with a brother-in-law and sister
before she remarried to John
Westfall. It is possible that
Thomas was Thomas Harrison Westfall,
but my Grandmother remembered
him as Thomas Smith but I believe
that was simply a mistake in
her memory.
